Our current terms and conditions are as follows.
All are subject to change and apply to all Jadalas Web Services customers.

These terms and conditions constitute the entire agreement between Jadalas Web Services and its clients/customers. These terms and conditions depose all prior agreements whether verbal or in writing.

All Jadalas Web Services clients agree to abide by these terms and conditions and those of our regular web hosting company Powersoft Hosting. Jadalas Web Services are a Powersoft Hosting reseller and as such like all our clients are bound by their terms and conditions.

Being a reseller means that we purchase a set amount of web space and bandwidth from Powersoft Hosting on a 12 monthly basis and then allocate portions of this to clients who choose us to develop their web site. What this means to our clients is that their web site will also incur a yearly hosting charge relevant to the amount of web space and bandwidth required to host their site. Payable 12 months to the day their site goes "live" (completed web site posted for public viewing)

Jadalas Web Services will register a domain name, design the site and update it as per the specific package purchased or the individual package put together for the client.

A domain name will be registered in the client's name and it is the client who will own the domain name and be responsible for any renewal fees thereafter.

The client also authorises Jadalas Web Services to promote their web site on search engines. Exact specifications of the submissions are liable to change.

CONTENT

The client is at all times responsible for the content of their site, including both text and images. If changes are required then reasonable notice must be given to Jadalas Web Services for the changes to be made. Updates will be done by Jadalas Web Services normally within 48 hours of receipt.

COSTS

The cost of the web site project will be as laid out in the individual quote provided for the customer. The quote will be based on any text for inclusion in the project being supplied in electronic file format e.g. Word Document, text file, email etc. If text is supplied in paper format an additional cost of £15 per hour (minimum £5) will be incurred.

WEB SPACE AND HOSTING

Jadalas Web Services uses Powersoft Hosting to host the web sites we design. The cost of both hosting and domain registration is included in any quote given unless requested otherwise. If the client already has a domain hosted elsewhere it will need to be transferred to Powersoft Hosting to allow Jadalas Web Services to effectively manage. Any charges imposed by their existing host will be met by the client.

PAYMENT

A £20 deposit payment is required prior to the commencement of work by Jadalas Web Services this is to cover the costs of domain name registration and server space allocation. Full payment will be required upon completion of the project.

At the time of the renewal of the site, 12 months after the web site goes "live" (completed web site posted for public viewing) a payment of £25 will be due if the client wishes their site to be hosted for a further 12 months. The renewal payment is required before the server space will be renewed by Jadalas Web Services. Delay in making this payment could cause problems ultimately resulting in the web site being deleted by our suppliers.

This is particularly the case if renewal of the domain name is due as ample processing time is needed for this to happen. Domain names will normally disappear on the expiry date if not renewed. Jadalas Web Services will not renew any web space without payment or written confirmation in the form of an official purchase order.

In the case of immediately necessary work, where pre-payment is required but is not practical, payment should be made within 7 (seven) days of the receipt of an invoice from Jadalas Web Services.

In the case of non-payment, interest will be charged at 2% monthly on all unpaid invoices in excess of three months. Jadalas Web Services reserves the right to issue a notice of termination to customers in excess of 6 months in arrears. Legal action to recover money owed will also be considered

A 7 day notice of termination will be sent in the case of continued non-payment. After the period of seven days, Jadalas Web Services reserves the right to delete the web site concerned.

LEGAL ISSUES

Jadalas Web Services does not warrant that the functions contained in the Internet web site will meet the client's requirements or that the operation of the web pages will be uninterrupted or error-free. The entire risk as to the quality and performance of the web pages and web site is with the client.

All customers of Jadalas Web Services automatically accept the terms and conditions of our regular hosting suppliers Powersoft Hosting.

BULK EMAILING

The sending of unsolicited email (spamming) is explicitly against the terms and conditions of Jadalas Web Services and of our web hosts. Jadalas Web Services will not partake in or advise in any way on the use of unsolicited bulk email apart from to say it is definitely not recommended.

Our web hosts will not allow their servers to be used in this way and will suspend the accounts of any web site owner that tries to do so. Bulk emailing causes IP addresses to be blacklisted thus affecting the email and web sites of their and our other customers.

Only bulk email to opt in email addresses is permitted.

SITE HITS/VISITORS

Jadalas Web Services does not guarantee a large number of visitors to its clients sites and strongly recommends that the client markets their site around the internet and off line too. Jadalas Web Services will provide help and advice regarding the best ways to market a business on the internet as well as search engine submission.

In no event will Jadalas Web Services be liable to the client or any third party for any damages, including any lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate the web pages or web site, even if Jadalas Web Services has been advised of the possibility of such damages.

COPYRIGHTS AND TRADEMARKS

The client represents to Jadalas Web Services and unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to Jadalas Web Services for inclusion in web pages are owned by the client, or that the client has permission from the rightful owner to use each of these elements, and will hold harmless, protect, and defend Jadalas Web Services and its subcontractors from any claim or suit arising from the use of such elements furnished by the client.
